1. Purpose

The purpose of this legal notice is to describe the legal conditions applicable to the USER’s access and use of the information contained on the Website, the digital magazine owned by CODIGO 4X4, and to comply with the obligations established in Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE).

The USER is informed and accepts that access to the Website does not, in and of itself, constitute the beginning of a commercial or other relationship with the Company. To purchase services or products offered on the Website (including free services and promotions), you must use the channels provided for this purpose, where you may be required to accept new legal, purchasing, or privacy terms and conditions.

2. Content, accuracy and updating.

CODIGO 4X4 periodically reviews the content and information published on the Website; however, these may not be exhaustive or up-to-date. Therefore, CODIGO 4X4 assumes no responsibility for any lack of updating or accuracy of the information, data or content published on the Website. CODIGO 4X4 also cannot control the use that the USER makes of the published information and, therefore, will not be liable for any type of damage or loss, whether direct or indirect, that may arise from the use of said information.

CODIGO 4X4 performs extensive maintenance of the website to ensure access to its services and content is always available. However, the USER accepts that interruptions may occur, either scheduled to improve website performance or for similar purposes, or accidental interruptions due to causes beyond the company’s control or beyond its control.

3. Intellectual and industrial property

All elements of the Website, such as its programming, source code, digital magazine, texts, designs, presentation, assembly, logos, images, and any other element susceptible to intellectual property protection, are the exclusive property of CODIGO 4X4 or it has authorization or license from the holders of their exploitation rights. Likewise, all trade names, trademarks or distinctive signs, logos, symbols, mixed, figurative or nominative marks that appear on this Website belong to CODIGO 4X4 or it has, prior authorization, the right to use them and are protected by current legislation in this regard.

Except for content expressly provided for in another applicable license, CODIGO 4X4 does not grant any license or authorization to use its industrial and intellectual property rights or any other property or right related to the Website, except by express agreement with third parties. Users may reproduce the contents of the Website solely for the purpose of reading the digital magazine, making backup copies, or printing them on paper for private use.

Aside from the foregoing, any reproduction, distribution, transformation, presentation, in whole or in part, of the content of the Website or any of its elements, whether directly or indirectly via telematic networks or similar media, for commercial purposes directed at the public or for any use beyond those mentioned above, is prohibited, even if the source is cited, unless expressly authorized in writing by CODIGO 4X4 and, where applicable, by third-party collaborators. The following are specifically prohibited:

– The presentation of the Website page within the frame of another web page that does not belong to CODIGO 4X4, using the technique called “framing” or similar technique, unless you have the express written consent of CODIGO 4X4.

– The insertion of an image distributed on the Website into a page or database not belonging to CODIGO 4X4, using the technique known as “in line linking” or a similar technique, if this does not have the express authorization of CODIGO 4X4.

– The extraction and use of elements from the website or the digital magazine, whether or not causing any harm to CODIGO 4X4, in accordance with the provisions of Royal Legislative Decree 1/1996, of April 12, which approves the Revised Text of the Intellectual Property Law and Law 5/1998, of March 6, on the Incorporation into Spanish Law of Directive 96/9/EC on the Legal Protection of Databases.

-CODIGO 4X4 must expressly authorize the establishment of hypertext links (hyperlinks) on another website directed to the homepage of this website or any other internal page of this website, provided that the corresponding pages appear in a full window and under the electronic addresses of the same.

Failure to comply with the above will entitle CODIGO 4X4 to take any legally recognized actions to defend its legitimate interests.

4. Temporary information files

The CODIGO 4X4 website does not use “cookie” technology or store any information on the device from which it is accessed. It also does not use any device that collects personalized information about user browsing. However, CODIGO 4X4 reserves the right to use cookies in the future, solely for the purpose of facilitating navigation and usability for those who access its digital magazine, and providing appropriate information.

5. Links

The external links you may find on the Website lead to other websites owned by third parties. The Company is not responsible for the content of these sites and does not guarantee their accuracy or up-to-dateness. The presence of these links on our Website is for informational purposes only and in no way constitutes a suggestion, invitation, or recommendation regarding them.

6. Applicable legislation

These terms and conditions are governed by Spanish law. Any dispute or question regarding the Website or these terms and conditions shall be resolved before the Courts and Tribunals of Lleida.

If any of the clauses of this legal notice were declared null or void, in whole or in part, this will not invalidate the rest, which will remain in force unless CODIGO 4X4 declares otherwise.

PRIVACY POLICY

1. Introduction

In accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data and its implementing regulations, we inform you that the personal data collected through the “subscription to receive the editions we publish” option or other data that you voluntarily provide to access our services will be incorporated into the “USERS” file.

2. Data collection

The USER guarantees that the Personal Data provided to CODIGO 4X4 is true and correct, and is responsible for notifying the latter of any changes. If the data provided belongs to a third party, the USER guarantees that they have informed said third party of the information contained in this document and obtained their authorization to provide their data. By providing this data, the USER declares that they have read and are aware of this Privacy Policy, and that they give their unequivocal and express consent to the processing of their personal data in accordance with the purposes and terms set forth herein.

3. Purposes

The collection and processing of personal data through any of the forms on the CODIGO 4X4 website has the following purposes:

-Allow the USER to access the digital magazine subscription CODIGO 4×4
-Respond to questions posed by USERS (both registered and unregistered)
-Send information via various means about CODIGO 4X4, its news, events, activities, contests, offers, promotions, new products, and services.

4. Data transfer

The USER acknowledges and accepts that their personal data may be provided to third parties when necessary to fulfill the purposes described above, as well as transferred to third-party collaborators of CODIGO 4X4 so that they can provide, by various means, information on products and services related to the off-road world, respecting in all cases the security measures required by current legislation on the protection of personal data as well as the general quality and privacy policies of the Company.

Except for the provisions contained in the previous paragraph, CODIGO 4X4 will not communicate the User’s data to third parties beyond those required by current data protection regulations and their implementing provisions, other than those made to the competent authorities when required.

5. Exercise of rights of access, rectification, cancellation and opposition.

6. Social networks

The social media profiles maintained by CODIGO 4X4 will not involve any data processing beyond what the social network itself allows for corporate profiles. CODIGO 4X4 may use these profiles to inform users of each social network subscribed to the CODIGO 4X4 profile about its activities, events, seminars, offers, promotions, or news about its products or services, as well as to share information of interest on the company’s usual topics. CODIGO 4X4 will not extract any data directly from the social network.
